In contracts concluded between a consumer and a business (hereinafter: consumer contract), warranty: the statutory warranty pursuant to the Civil Code and the mandatory warranty provided by separate legislation for consumer contracts

Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services;

Act V of 2013 on the Civil Code;

Government Decree 151/2003 (IX.22.) on Mandatory Warranty for Certain Durable Consumer Goods;

Government Decree 45/2014 (II.26.) on the Detailed Rules of Contracts between Consumers and Businesses;

NGM Decree 19/2014 (IV.29.) on the Procedural Rules for Handling Warranty and Guarantee Claims Regarding Goods Sold under Contracts between Consumers and Businesses

3. Scope of the GTC, Amendment of the GTC

In addition to the mandatorily applicable legislation, these GTC shall apply to the contract concluded between you and the Seller. The Seller is entitled to amend the provisions of these GTC within the framework of the applicable legislation. Please read the provisions of the GTC before each purchase. Any amendment to the GTC shall become effective upon its publication on the website. Any amendments shall not affect contracts already concluded (confirmed orders).

3.1. Acceptance of the GTC

Before finalizing your order, you are required to familiarize yourself with the provisions of these GTC. By purchasing through the www.protocolpresent.com website, you accept the provisions of these GTC, and the GTC shall form an integral part of the contract concluded between you and the Seller.

3.2. Language of the contract

Contracts falling under the scope of these GTC shall be concluded in Hungarian.

3.3. Information on the form of the contract

Contracts falling under the scope of these GTC shall not be considered written contracts; they are not filed by the Seller, and after performance the data related to the contract are not stored. We recommend that you retain the data confirming your purchase for the purpose of any future claims.

3.4 Prices

Prices are stated in Hungarian Forints and include 0% VAT. Prices are for information purposes only, and we reserve the right to change prices.

4. Additional Consumer Information

You qualify as a consumer if you purchase from the Seller as a private individual (natural person) acting outside the scope of your profession, independent occupation, or business activity. Information concerning consumer rights is available via the relevant link.

5. Complaint Handling and Legal Remedies

5.1. Complaint handling

In the event of a consumer complaint, the Seller shall endeavor to carry out repair or replacement within a maximum of fifteen days. If the consumer does not agree with the handling of the complaint, or if investigation of the complaint is not possible, the Seller shall promptly record the complaint and its position in minutes and provide a copy thereof to the consumer or send it by e-mail.

5.2. Other legal remedies

If a consumer dispute between the Seller and the consumer is not resolved during negotiations, the following legal remedies are available to the consumer:

Turning to a Conciliation Board. For the out-of-court, amicable settlement of consumer disputes concerning the quality and safety of products, the application of product liability rules, and the conclusion and performance of contracts, the consumer may initiate proceedings before the conciliation board operating alongside the competent professional chamber according to the Seller’s registered office. The Seller shall cooperate during the proceedings. For the purposes of the rules governing conciliation boards, a consumer shall also include civil organizations, churches, condominiums, housing cooperatives, and micro, small and medium-sized enterprises as defined by separate legislation that purchase, order, receive, use or are the addressee of commercial communications or offers regarding goods.

Online dispute resolution platform. The European Commission has created a website where consumers may register, thereby enabling them to settle disputes related to online purchases by completing a form, thus avoiding court proceedings. In this way, consumers can enforce their rights without, for example, distance preventing them from doing so. If you wish to lodge a complaint regarding a product or service purchased online and do not necessarily wish to go to court, you may use the online dispute resolution tool. On the portal, you and the trader against whom you have lodged a complaint may jointly select the dispute resolution body to handle the complaint. Court proceedings. The consumer is entitled to enforce claims arising from a consumer dispute before a court in civil proceedings pursuant to Act V of 2013 on the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure.

In consumer protection administrative cases, the consumer protection departments of the capital and county government offices act at first instance with county competence. Jurisdiction may be established by the consumer’s place of residence, the business’s registered office or place of business, as well as the place where the violation was committed. The application may be submitted to any competent authority.

7. Copyright

Pursuant to Act LXXVI of 1999 on Copyright, the website qualifies as a copyrighted work; therefore, all parts thereof are protected by copyright. Pursuant to Section 16 (1) of the Act, unauthorized use of graphic and software solutions and computer programs found on the website, as well as the use of any application by which the website or any part thereof may be modified, is prohibited. Any material may be taken from the website and its database, even with the written consent of Talpas Design Grafikai Kft., only with reference to the website and indication of the source.

8. Miscellaneous

If any provision of these GTC is legally incomplete or invalid, the remaining provisions of the contract shall remain in force, and the applicable provisions shall replace the invalid or erroneous part.
The Seller does not have a code of conduct under the Act on the Prohibition of Unfair Commercial Practices against Consumers.

9. Operation of digital data content, technical protection measures

The availability of the servers providing the data displayed on the website exceeds 99.9% per year. Data content is stored on servers using RAID technology on multiple hard drives. If any hard drive is damaged, the system remains operational using the remaining hard drives. Full backups of all data content are made regularly so that the original data content can be restored in case of any problem.

10. Compatibility of digital data content with hardware and software

The data displayed on the website are stored in a MySQL database. Sensitive data are stored with encryption of appropriate strength, and hardware support built into the processor is used for encoding.


11. Information on the use of the website

11.1. Information on the essential characteristics of the products

On the website, we provide information on the essential characteristics of the products available for purchase in the product data sheets and product descriptions for each product. The information displayed on the product page is for information purposes only. Images are sometimes illustrations and colors may not always correspond to reality.

11.2. Correction of data entry errors – Responsibility for the accuracy of provided data

During the ordering process, you have the opportunity to modify the data you have entered before finalizing your order. Please note that it is your responsibility to ensure that the data you provide are entered accurately, as the invoice and delivery of the product are based on the data you provide. By placing your order, you acknowledge that the Seller is entitled to pass on to you any damages and costs arising from incorrect data entry or inaccurately provided data. The Seller excludes liability for performance based on inaccurate data entry. Please note that an incorrectly provided e-mail address or the storage capacity of the mailbox being full may result in the non-delivery of the confirmation and may prevent the conclusion of the contract.

11.3. Procedure in case of incorrect price

It may occur that an incorrect price – for example due to a typographical error – appears on the website. In case of an offer made at an incorrect price, no contract shall be concluded between us. If you make an offer at an incorrect price, the system will automatically confirm it; however, this does not constitute acceptance of your offer on our part. In the event of an offer (order) made by you at an incorrect price, the Seller’s employee shall inform you of the correct price in a non-automatic electronic confirmation and may offer the conclusion of the contract at the correct price. You are not obliged to make an offer or conclude a contract at the correct price communicated by the Seller instead of the incorrect price. In such case, no contract shall be concluded between the parties.

12. The ordering process

You are not required to register to use the website or to make a purchase. For more convenient shopping, we recommend registering, as this way you will not need to enter your details again for future purchases.

The information provided on the website does not constitute an offer by the Seller to conclude a contract. In the case of orders falling under the scope of these GTC, you qualify as the offeror, and the contract is concluded upon the Seller’s acceptance of your offer made through the website in accordance with these GTC.

12.1. Selection of the Product

By clicking on the product categories displayed on the website, you can select the desired products. By clicking on individual products, you will find the product photo, item number, description, price and size. In the event of a purchase, you are required to pay the price indicated on the website. Products are illustrated with photos.

12.2. Adding to cart

After selecting the Product, you may place any number of products in the cart by clicking the “Add to cart” button without incurring any purchase or payment obligation, as placing a product in the cart does not constitute making an offer.

We recommend placing the product in the cart even if you are not sure whether you wish to purchase it, as this allows you to review at a glance which products you have selected at that moment and to view and compare them on a single screen. The contents of the Cart can be freely modified until the order is finalized; products can be removed from the cart, new products can be added, and the desired quantity can be changed.

If you do not wish to select additional products, click on the “Cart” button at the top of the website, then click on the “Proceed to checkout!” button.

12.3. Viewing the Cart

During the use of the website, you may check the contents of your cart at any time by clicking on the “Cart” icon at the top of the website. Here, you have the option to remove selected products from the cart or change the quantity of products.

If you do not wish to select additional products and place them in the cart, you may continue the purchase process by clicking the “Proceed to checkout!” button.

12.4. Providing customer details

After clicking the “Proceed to checkout” button, you may continue the purchase by entering your shipping details. Thereafter, you may select the desired payment and delivery method.

12.5. Reviewing the order

As the final step of the purchase process, before finalizing your order, you may review your order. Here you can see a summary of the data you previously provided, including the contents of the Cart, user, billing and shipping details, and the total amount payable by you. In the text box at the bottom of the page, you may provide additional information at your discretion.

13. Finalizing the order (making an offer)

If you are satisfied that the contents of the cart correspond to the products you wish to order and that your details are correct, you may finalize your order (submit your offer) by clicking the “Purchase” button. By clicking the “Purchase” button, you expressly acknowledge that your offer shall be deemed made, and your declaration – in the event of confirmation by the Seller pursuant to these GTC – entails a payment obligation.

14. Processing of the order

Orders are processed continuously. You may place your order at any time. You will receive an automatic confirmation of your order as specified in Section 14.1. If the order is placed after working hours, it will be processed on the next working day. Your offer shall bind you for a period of 48 hours only if the Seller does not confirm it in accordance with Section 14.1 of these GTC.

14.1. Automatic confirmation e-mail, conclusion of the contract

After placing your order, you will receive an e-mail notification from the Seller to the e-mail address you provided. This confirmation is an automatic e-mail confirming that your order has been received via the website, and this confirmation shall be deemed acceptance of your offer. If you notice that the automatic confirmation e-mail contains incorrect data (e.g. name, shipping address, phone number, etc.), you are obliged to notify us immediately by e-mail, providing the correct data at the same time. If you do not receive the automatic confirmation e-mail within 24 hours of placing your order, please contact us, as it is possible that your order was not received in our system due to technical reasons.

It may occur that the product selected by you is not available in our warehouse; the actual performance time depends on stock availability. You will be informed of this and may indicate whether this is acceptable to you. If you are unable to accept the delivery deadline and notify the Seller of this fact by e-mail within 48 hours of receipt of the e-mail sent by the Seller to your mailbox, no contract shall be concluded, and neither you shall be obliged to pay nor the Seller shall be obliged to deliver.

15. Payment methods and conditions

15.1. Total payment obligation

The order summary and the confirmation e-mail referred to in Section 14.1 contain all costs payable by you.

 

16. Receipt of the ordered product – delivery methods

16.1. MPL home delivery with cash on delivery
Under this delivery method, ordered products are delivered by Magyar Posta, which may carry out deliveries on working days between 8 a.m. and 5 p.m. Delivery takes place on the working day following dispatch. The fee for this delivery method, including the HUF 200 cash on delivery fee, is HUF 1,810.

16.2. MPL home delivery by bank transfer
Under this delivery method, ordered products are delivered by Magyar Posta, which may carry out deliveries on working days between 8 a.m. and 5 p.m. Delivery takes place on the working day following dispatch. The fee for this delivery method is HUF 1,590.

16.3. MPL poste restante package collection with cash on delivery
Under this delivery method, you may specify at which post office you wish to collect your package during the opening hours of the given post office. Delivery takes place on the working day following dispatch. The fee for this delivery method, including the HUF 200 cash on delivery fee, is HUF 1,710.

If the Buyer does not collect the package at the selected post office by the fifth working day following its arrival and it is returned to us, the delivery fee shall be borne by the Buyer. In such case, the package will be resent only after advance payment of the purchase price of the ordered product(s).

16.4. FOXpost parcel locker with cash on delivery
Under this delivery method, you may specify from which FOXpost locker you wish to collect your package. Delivery takes place within 1–3 working days following dispatch. The fee for this delivery method, including the HUF 200 cash on delivery fee, is HUF 1,340.

16.5. FOXpost parcel locker by bank transfer
Under this delivery method, you may specify from which FOXpost locker you wish to collect your package. Delivery takes place within 1–3 working days following dispatch. The fee for this delivery method is HUF 1,130.

If the Buyer does not collect the package from the selected FOXpost locker by the fifth working day following its arrival and it is returned to us, the delivery fee shall be borne by the Buyer.

16.6. Permitted delivery address

The delivery address of the products may only be an address located within the territory of Hungary. In the event of a request for delivery outside the borders of Hungary, please contact us for individual consultation (in such case, the indicated delivery fees do not apply and are valid only for delivery addresses within Hungary).

16.7. Presumption of entitlement to receive

The Seller shall consider the person entrusted with receiving the product to be your designated representative who is authorized not only to receive the product but also to make legal declarations related to delivery and acceptance.

17. Procedure for quality and quantity complaints

At the time of delivery and acceptance, you are obliged to inspect the received product and report any quality or quantity objections observable upon visual inspection, and to compare the received product with the items listed on the invoice and communicate any discrepancies.

If possible, examine the package in the presence of the courier upon delivery and, in the event of damage, request that a report be drawn up.

18. Performance deadline

The general performance deadline for the order is no more than 10 working days from confirmation of the order or – if the Seller exercises this right – from the crediting of the advance payment to the Seller’s bank account. This delivery deadline is for information purposes only; any deviation will be indicated in all cases by e-mail. By accepting these GTC, you acknowledge that the Seller expressly excludes liability for damages due to exceeding the indicated delivery time.


19. Reservation of rights

It may occur that the distribution of certain products displayed on our website has been discontinued. In this regard, we reserve the right to refuse confirmed orders in whole or in part. Partial performance may only take place after consultation with you. If the purchase price of the product has been paid in advance, the amount will be refunded to you within 14 working days.
